Terms and Conditions

Terms and Conditions

Last updated: September 10, 2026

1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between Madalina Moman, Watzmannstraße 12, 71067 Sindelfingen, Germany ("Esimoon", "we", "us") and the customer ("you") via the website esimoon.com and the eSIMoon mobile application.

By placing an order, you agree to these Terms and Conditions. Conflicting terms of the customer are not recognized unless expressly agreed to in writing.

2. Subject of the Contract

Esimoon provides digital eSIM data plans for mobile devices. The products are exclusively digital goods delivered electronically as QR codes or activation codes. No physical goods are shipped.

3. Contract Formation

The product presentation on our website does not constitute a binding offer, but an invitation to place an order (invitatio ad offerendum). By completing the checkout process and clicking "Pay Now", you submit a binding offer to purchase. The contract is formed when we send you the order confirmation email with the eSIM QR code/activation details.

4. Prices and Payment

All prices are stated in euro (EUR). The total price shown before you submit your order is the amount payable. The payment methods available for your order are shown at checkout. Payment is due upon order placement. An order or payment confirmation is not automatically an invoice. Where an invoice is legally required, we issue it independently of a separate request. Otherwise, you can request an invoice from our support team, quoting your order number. Please provide complete and accurate billing details. Invoices are issued in German. PDF delivery by email requires your consent where required by law. Mandatory invoicing requirements remain unaffected.

5. Delivery of Digital Content

Upon successful payment, your eSIM QR code and activation details are delivered immediately via:

  • Your account dashboard on esimoon.com
  • The eSIMoon mobile application
  • Email confirmation

Delivery is considered complete once the eSIM data is made available to you in your account.

6. Right of Withdrawal (Widerrufsrecht)

Withdrawal Instructions

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., a letter or e-mail) of your decision to withdraw from this contract:

Madalina Moman
Watzmannstraße 12, 71067 Sindelfingen, Germany
E-Mail: info@esimoon.com
Phone: +49 162 289 6798

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, without undue delay and no later than 14 days from the day on which we received the notification of your withdrawal. We will use the same means of payment as you used for the initial transaction, unless you expressly agreed otherwise; in no event will you be charged fees as a result of such reimbursement.

Exception for Digital Content (§ 356 Abs. 5 BGB)

The right of withdrawal expires prematurely if we have begun delivering the digital content (eSIM activation) before the end of the withdrawal period, and you have:

  • Given your express consent to the beginning of delivery before the withdrawal period has expired, and
  • Confirmed your knowledge that you thereby lose your right of withdrawal.

In practice: Once you scan the eSIM QR code and install/activate the eSIM on your device, the right of withdrawal is extinguished.

7. Customer Obligations

  • You are responsible for ensuring your device is eSIM-compatible before purchase.
  • You must provide accurate account and billing information.
  • You agree not to misuse the service or resell eSIM products without authorization.

8. Warranty and Liability

Statutory warranty rights apply. We are liable without limitation for damages arising from injury to life, body, or health due to intentional or negligent breach of duty. For other damages, we are liable only in cases of intent and gross negligence, except for the breach of essential contractual obligations (cardinal obligations). In the case of a breach of cardinal obligations due to simple negligence, liability is limited to foreseeable, contract-typical damages. Liability under the German Product Liability Act (ProdHaftG) remains unaffected.

9. Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.

10. Dispute Resolution

The European Online Dispute Resolution (ODR) platform was discontinued on July 20, 2025. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

11. Severability

Should any provision of these Terms be or become invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely approximates the economic intent of the invalid provision.
